1. Acceptance of Terms

By using any of Techfluence's services, including WhatsApp Business API setup, broadcast campaign management, and chatbot automation, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our services.

2. Changes to Terms

Techfluence reserves the right, at its sole discretion, to modify or replace these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services following any changes indicates your acceptance of the new terms. We recommend reviewing these terms periodically for any updates.

3. Service Use and Restrictions

Techfluence provides specialized digital services, which include but are not limited to:

• Setting up and configuring the WhatsApp Business API.

• Acquiring necessary permissions from Meta for WhatsApp integration.

• Assisting in obtaining the verified tick from Meta.

• Developing and managing WhatsApp broadcast campaigns.

• Creating and maintaining WhatsApp automation chatbots.

• Website Development, App Development, and other services

You agree to use these services in compliance with all applicable local, state, national, and international laws and regulations. Unauthorized use of the services, including but not limited to misuse of any information, data, or content, is strictly prohibited.

4. User Responsibilities and Account Security

You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to immediately notify Techfluence at [email protected] of any unauthorized use of your account or any other security breach.

5. Intellectual Property Rights

All materials, content, and trademarks associated with Techfluence's services are the sole property of Techfluence or its licensors and are protected by intellectual property laws. You are granted a non-exclusive, non-transferable, revocable license to access and use the services according to these terms.

 

6. Disclaimer of Warranties

Techfluence's services are provided "as is" and "as available" without any warranties, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Techfluence does not warrant that the services will be uninterrupted, timely, secure, or error-free.

 

7. Limitation of Liability

Techfluence, its affiliates, and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

8. Indemnification

You agree to defend, indemnify, and hold harmless Techfluence, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the services, your violation of these Terms, or your violation of any third-party rights.

9. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Techfluence operates, without regard to its conflict of law provisions. You agree that any legal action or proceeding related to these terms or your use of the services shall be conducted in the appropriate courts of said jurisdiction.
